Found a mark that conflicts with yours?

Opposition must be filed within four months of publication. That period is set by statute and is not ordinarily extended, so if a published mark is close to yours it is worth getting advice early rather than at the end of the window.

About the journal

What is the Trade Marks Journal?

It is the official weekly publication of the Trade Marks Registry. Once an application clears examination it is advertised here, which starts the window in which anyone may oppose it.

How long do I have to oppose a published mark?

Four months from the date the mark is published in the journal. The period is set by the Trade Marks Act and is not ordinarily extended, so a mark that concerns you needs to be acted on quickly.

What does each entry contain?

The application number, the wordmark or device, the class and the specification of goods or services, and the name and address of the applicant, along with the filing and user details claimed.

My mark has been published — what happens next?

If no opposition is filed within four months, the application proceeds to registration and the certificate is issued. If an opposition is filed you will receive a notice and must file a counter-statement within two months.

Why is the journal split into several PDFs?

Each weekly issue is large, so the Registry publishes it in parts covering ranges of classes. Open the part that covers your class.
